Capability and Performance

Employment Law in Practice

Initially, if there are some performance issues, it maybe possible for the employee's manager to deal with them.  Alternatively, if an informal meeting is inappropriate then a formal hearing could be held with the usual procedures applying.  On most performance issues you need to give the employee some time to improve and set out a performance plan.

  • Keep the employee fully informed at all stages
  • Use clear and achievable objectives with a reasonable timescale
  • Offer assistance, training and supervision
  • Genuinely attempt to avoid dismissal
  • Comply with the statutory procedure
  • Keep the process well documented
  • Employers should allow a right of appeal
