The amount of compensation is normally limited to two factors
- The statutory maximum award - that is at least £76,700 in 2009 and is usually increased every year
- The loss of earnings from dismissal to getting a new job, if the new job is paid less then the shortfall in net earnings is taken into account
So, the longer the employment action continues without the employee finding a new job the more likely the employer's solicitor will increase the compensation package. Employment litigation with a valid claim, in effect, can be seen as a form of insurance, just in case the employee cannot mitigate his losses by finding a new job.
